You may use Texas Divorce Online to start your divorce case even if you do not believe your spouse will sign the documents or if you do not know the whereabouts of your spouse. Similar, if you and your spouse just haven’t reached an agreement on all the terms of your divorce, you can still use Texas Divorce Online to start your divorce case. The cost of the case starting service is $99.
The first step in any divorce action is to file a Petition for Divorce with court. The next step is to notify your spouse of your desire to divorce. Three options exists to notify your spouse. And official notification can’t be given until after you start the divorce action with the court.
The three options are: 1) your spouse signs a waiver of service. This is usually done when you and your spouse are in agreement. 2) have your spouse served (usually by the sheriff or private process server). This is usually done if your being uncooperative and doesn’t want to sign a waiver of service. 3) service by publication. This is done when you explain to the court you have searched for your spouse but can’t locate them. The court will then allow you to run an ad in a newspaper and this will be considered alternative service allowing you to divorce without your spouse’s signature or traditional service.

The other benefit of getting your case started is that Texas has a sixty day waiting period before you can finalize your divorce. That sixty day clock begins once you start your case with the court.
After your spouse is notified by any one of the three steps above, your spouse has a little less than 30 days to respond to the court.
