Explanation of Residency Requirements:

You or your spouse must be either (1) a domiciliary of Texas or (2) be a military service member stationed in Texas. In either scenario you or your spouse must be domiciled or stationed in Texas for at least six months and be a resident of the county for at least 90 days at the time of filing the Petition for Divorce with the county district court. You are domiciled in Texas if you live in Texas with the intention of making Texas your permanent home. For example, where do you primarily live? Sleep at night? Get your mail? What address is on your driver's license? What address is on your federal tax return? If Texas, then you are domiciled in Texas. Military service members do not have to be domiciled in Texas but simply stationed in Texas. If you or your spouse is a Texas resident and either of you is in the military or on government service you are considered a domiciliary of Texas if Texas is your home state.
